After five years of practicing law at the firm, Josh became a partner in 2014. Since joining Byrnes Keller Cromwell, Josh has represented entities and individuals in state and federal courts, and in private arbitrations, in a variety of complex commercial disputes including breach of contract, professional liability, director and officer liability, commercial real estate disputes, employment disputes, environmental litigation, and securities law violations. Representative engagements include:
- Estate of Calderwood v. Davis Wright Tremaine LLP (represented law firm and partner in two-week Zoom jury trial in King County Superior Court in legal malpractice suit filed by the estate of a former client resulting in a complete defense verdict for the clients)
- Alaska Native Regional Corporation Section 7(i) Litigation (successfully represented Sealaska Corporation in a two week arbitration relating to ANCSA’s application to revenue generated from the sale of California Air Resource Board carbon offset credits)
- BioMed Realty, LP v. 700 Dexter LLC (represented purchaser of environmentally contaminated South Lake Union property in one-week bench trial in U.S. District Court resulting in specific performance award in client’s favor requiring the seller to complete the sale and deliver the property to client)
- Taylor v. Book of Nines LLC, et al. (represented creditor of bankrupt start-up fashion company in seven-day King County Superior Court bench trial resulting in $800k judgment against individual defendant after successfully piercing the corporate veil)
- Washington Builders LLC v. BMR-Dexter LLC, et al. (represented current owner of South Lake Union property in remedial action cost recovery lawsuit under Model Toxics Control Act resulting in confidential settlement on the eve of trial)
- Law Firm v. Former Partner (represented AmLaw 100 firm in private arbitration with a former partner regarding breach of contract and wrongful termination claims resulting in complete dismissal of former partner’s claims and successful defense of award in the California Court of Appeal)
- Procedyne Corp. v. EnerG2, Inc. (King County jury trial resulting in six-figure verdict in favor of client-defendant/counterclaimant on breach of contract claim)
- Fair v. Powers & Therrien, P.S. (summary judgment dismissal of legal malpractice claim in Chelan County Superior Court; affirmed by Washington Supreme Court)
- Kern v. First Washington Corporation (ten day FINRA customer securities arbitration)
- Leibsohn v. Colliers International (represented real estate broker in defending tortious interference claim from competing broker resulting in summary dismissal by King County Superior Court; affirmed by Court of Appeals)
- Private Arbitration (represented professional limited liability company in private arbitration regarding breach of fiduciary duty claims against departing member-doctors)
- Capobianco v. Vulcan (represented employer in four-day arbitration regarding private equity contract dispute)
- Alaska Distributors v. Alaskan Brewing (obtained multi-million dollar judgment in dealer termination case in private arbitration; affirmed on appeal through the Washington Supreme Court)
